For the majority of people filing a lawsuit sounds frightening and complicated. We are used to think that things have gone really bad if the court is involved. However, it is not exactly the case when it comes to surrogacy.

Lawsuits to get a birth certificate without surrogate’s name

Only heterosexual couples who are married to each other can get the birth certificate of their “surrogate” child to their names only automatically. A court decision would be required for all other categories of intended parents: a single man, a single woman, or a couple who are not officially married.

This is when our lawyers help filing a claim to the court. We know how to represent your interests, what documents to attach, and what legal acts to bring up to the court’s attention. All the cases of single men, women and couples who are not officially married who entrusted our legal team to represent them in courts were successful.

The first and thus most important precedent victory happened in August 2010, when our team took a case of a single man who became a father through surrogacy and proved to the court that single men have exactly the same rights as single women and married couples for using surrogacy to becoming parents. The court ruled that civil registry offices should treat single men fathering children through surrogacy no different than couples and single women.

This was a sparkling beginning of a series of successful trials.

Changing the date of birth

Some of our clients pursue an IVF along with surrogacy. It means that embryos of genetic parents are transferred to the uterus of a surrogate and to the uterus of the intended mother at the same time.

Normally both women deliver children with a few days difference. It is possible, however, to change the birth date so that both children had the same date of birth.

It has to be done through a court decision as well.
