A single woman is recognized as a sole parent through surrogacy.

Ms. Natalia Gorskaya represented by Rosjurconsulting law firm challenged the law surrounding surrogacy and asked to be registered as a mother of her son who was carried by a surrogate. Before this precedent case the general belief in Russia was that only married heterosexual couples could be registered as legal parents of a surrogate-born baby.

Our attorneys proved to the Russian Court that such law interpretation discriminated against the rights of single women who wished to become mothers through surrogacy. The Court granted full parental rights to Ms. Gorskaya and ruled that single woman in Russia who pursues surrogacy should be treated the same as a married one who starts a surrogacy program with her husband as a couple – and can be registered as mother and single parent. As a result of this trial the first birth certificate to the name of a single intended mother in Russia and Europe was issued.

In 2010 Konstantin N. Svitnev, Rosjurconsulting C.E.O., challenged existing law applying practice of Russian surrogacy laws on discrimination grounds against single men. This move resulted in a historic decision of a Moscow court declaring that single men who became fathers through surrogacy have the same rights as married couples and single women to get birth certificates mentioning them as single parents.

As a result of our legal team efforts, the first-ever in Moscow, Russia and Europe birth certificate to a single intended father’s name only without mother’s name was issued.

In March 2011 another Russian court – this time in St. Petersburg, the second Russian capital – in another historic decision on a lawsuit represented by Rosjurconsulting law firm ruled that surrogacy law in Russia should unconditionally recognize children born to single intended fathers via surrogacy. The court ruled to issue a birth certificate naming only a plaintiff, a single Russian man, as a legal parent of the child, without surrogate’s name. Therefore, for the first time in St. Petersburg a single intended father was able to claim sole custody over a newborn baby.
